Candidate Data Privacy Guidelines At the National Broadcasting Company, Inc., a subsidiary of the General Electric Company (along with its affiliates and subsidiaries, referred to as "GE"), we are committed to protecting your privacy. The identifiable information about yourself that you provide to us as an applicant (the "Candidate Data" or "Data") will be used for recruitment purposes, and the Candidate Data will be protected in accordance with GE's Candidate Data Privacy Guidelines outlined below and all applicable laws. By submitting your Candidate Data, you confirm and agree that: (a) you have reviewed GE's Candidate Data Privacy Guidelines; (b) GE may process the Candidate Data according to the recruitment purposes set out in the Candidate Data Privacy Guidelines; and (c) the Candidate Data may be transferred worldwide consistent with GE's Candidate Data Privacy Guidelines. Your consent to provide the Candidate Data is required in order to complete the submittal process. Candidate Data Privacy Guidelines: These guidelines are derived from the GE Global Guidelines on Employment Data Protection and Privacy. They are intended to assist and educate you regarding the processing of Candidate Data. These guidelines, unless noted otherwise, do not form part of any contract of employment, where applicable, offered to successful hires. Where and as appropriate, GE may amend these guidelines from time to time. GE respects your privacy rights and interests and will apply the following principles when dealing with your Candidate Data: Data Privacy Principles: Data will be collected for the purposes specified below and used accordingly. The collection and processing of the data will be limited to these purposes and you are hereby informed in advance of the purposes and uses of such data. Data will be adequate, relevant and not excessive relative to the purposes for which they are processed. Data will be as accurate as possible and, as necessary in accordance with applicable laws, kept up to date. Subject to local legal requirements, Data will not be kept longer than is appropriate or necessary for the purposes for which it is being processed. Data will be collected, used and retained in accordance with your legal rights. Appropriate technical and physical measures will be taken to prevent unauthorized access, accidental loss, destruction or damage to data and any unauthorized organization, disclosure or processing. Processing: GE processes Candidate Data fairly and lawfully for the purposes of your potential employment (the "Purposes"). Processing for the Purposes includes obtaining, recording, holding, organizing, transferring, adapting, amending, recovering, consulting, using, limiting, disclosing by transmission, disseminating or otherwise making available, aligning, blocking, destroying and erasing Data. Candidate Data that is processed includes, but is not limited, to: Candidate status Work history/job data Education Compensation Employer feedback Online questionnaire results. This list is not exhaustive and may be changed and/or added to from time to time. Information Collection: Subject to local legal requirements, GE may use external service providers to collect, process and/or validate Candidate Data for the Purposes. GE requires that any such external service providers ensure adequate protection for Candidate Data and comply with local legal requirements. GE may periodically collect further information with your consent or in accordance with applicable laws. For example, GE may collect your feedback and opinions (e.g. surveys) for business purposes, such as improving processes. You may respond to these surveys voluntarily or may elect not to respond and will not suffer reprisals for your decision. These guidelines will be applicable to any further information collected including any responses to such surveys. Disclosure Within GE: To operate as a global business, it may be necessary to process and transfer Candidate Data within GE's worldwide operations. This may involve transferring Candidate Data outside your country. Processing and/or transfer of Candidate Data and release of Candidate Data within GE and/or to third parties outside your country is subject to local law and, where required, will be subject to your consent, as well as ensuring adequate security measures. Disclosure to Third Parties: GE may be obliged to disclose certain Candidate Data to third parties, such as government authorities, in accordance with applicable laws. It may be necessary to disclose certain Candidate Data to a supplier or contractor organization supplying services which require the use and/or creation of Candidate Data for the Purposes and in accordance with applicable laws. It may also be necessary to disclose Candidate Data so as to protect the legal interests and other rights of GE again in accordance with applicable laws. Candidate Data Security: GE ensures adequate security to protect manual and electronic processing of Candidate Data and prevent its misuse, all in accordance with applicable local legal requirements. GE separates Candidate Data into different categories depending upon the type and sensitivity of data being protected and, as appropriate, in accordance with applicable local legal requirements regarding the categorization of sensitive data. GE also ensures third parties and affiliates processing Candidate Data on its behalf; observe similarly adequate security measures again in accordance with applicable local legal requirements. Sensitive Candidate Data: GE ensures special protection for your sensitive personal information ("Sensitive Candidate Data"). GE defines Sensitive Candidate Data as including (but not necessarily limited to): Demographic data (e.g. sex, race, color, ethnic or national origin, religion, philosophical or political beliefs, trade union membership and criminal proceedings); Medical data (e.g. pre-placement medicals, and other medical documents produced for the purposes of employment, such as (where permitted by law), drug screen results); and Personal financial data. GE may process this type of data: for the purposes of equal opportunities monitoring; where prescribed by law; where needed for the protection of life, health or freedom; and where required for the performance of any employment contract offered to successful hires, all subject to appropriate security safeguards and in accordance with applicable local legal requirements. Where required by local law, your explicit consent will be obtained before the processing of Sensitive Candidate Data. Candidate Data Collection and Access to Candidate Data: You may use various methods to submit your Candidate Data to GE. These methods may include: (a) e-mail or paper submission to GE personnel; (b) online resume submittal processed by a third party service provider into an electronic database based in the U.S. accessible by GE authorized personnel; or (c) via a GE employment application. If your Candidate Data is held in an electronic database, either through your submission process or from completing an online questionnaire: You have the right to see Candidate Data that GE holds about you (subject to applicable local legal limitations and requirements). You should send a request in writing to the: NBC Olympics Human Resources Data Protection Administrator 30 Rockefeller Plaza, New York, New York, 10112, if you would like to view your Candidate Data, correct your Candidate Data, discuss the outcome of the results of your online questionnaire or have questions regarding these Guidelines or your Candidate Data. Any letters sent to this address for any other purpose other than the above will not be responded to and will be discarded. The Human Resources Data Protection Administrator will confirm your rights of access to such Candidate Data. Candidate Data will be available for access for a reasonable period of time, and GE will allow you to view your Candidate Data upon reasonable notice and at reasonable times. The retention and access to Candidate Data shall all be in accordance with applicable local legal requirements. GE makes all reasonable efforts to maintain the accuracy of the Candidate Data, but you are encouraged to ensure that Candidate Data is kept up to date and amend Candidate Data that is inaccurate or out of date (e.g. name and address). GE will endeavor to resolve any issues concerning your Candidate Data in accordance with relevant procedures. |
